Here's what I've learned from a SCCA friend that is a Insurance  broker:
A few years ago one insurance company (I'm not naming names) office in the  
eastern US was dropping clients as "high risk" that were involved in 
competitive  driving events. The treat of a class action law suit stopped this 
habit.
 
Now as for an attendee that refuses to even give their name. An SCCA (or  
other organization) autocross is NOT a public event just because it is held  
outside. Everyone must sign an insurance waiver refusing to do so will get 
you  removed. A person that is attending and taking pictures could be asked 
to leave.  In fact anyone can be asked to leave and the authorities can be 
asked to assist  removing said person. You can think of the autocross as a 
wedding and everyone  is a guest or crasher.
