The biggest problem is aeration.  If the oil level gets high enough  for 
the moving parts to contact the oil then the "beaten" oil becomes  aerated 
(more like a foam and less like a liquid) and it cannot be  pressurized by the 
oil pump.  This results in at least two conditions--much  lower oil pressure 
and disruption of the oil film on points of highest load  such as the main 
bearings, the lifter to cam surfaces and rocker wear  points.  V and inline 
designs typically have the crankshaft below the cam  where the spinning 
counterweights will whip up the oil quickly while the Corvair  engine places the 
cam at the lowest point, but it is still a spinning mass of  lobes that 
will also quickly aerate the oil.
 
If your dipstick tube is properly installed and you have the correct  
Corvair dipstick then just keep the oil level at or slightly below the "full"  
mark.  4 1/2 quarts works just fine.
