MAybe, but the auto industry is used to getting sued, and they don't like to lose money. So...

In our litigious society, the liability issue is never cleared.  If 
someone crashes their car while using a mini-spare, they will have no 
problem finding a lawyer who will happily sue the tire manufacturer, the 
wheel maker, the car manufacturer, and any other "deep pocket" they can 
connect to the matter.

The merits of matter as perceived by us is not relevant.  Someone will 
sue, and there will be a settlement.

There may exist case law on this, as it seems likely to me that someone 
has already brought such a suit.
