Using another seller's photos or advertising text is against eBay policy (I 
know that I saw it in there when I was looking for something else), but the 
owner has to complain about it, and then eBay will probably suspend the 
offending pirate indefinitely until they get around to determining whether 
it's true or not.  (Although eBay's policy is to thoroughly investigate 
BEFORE taking action, they usually just knock you out and think later. See :
