Well, if it was caused by the wind of motion pushing up a not fully latched 
(sticky latch?) deck lid, I can see where the carrier could make a case for 
mechanical failure of the latch.

The damage you describe is not "mechanical failure," but body damage.

Did you specify that the car was to be hauled in a closed van, or did you 
leave
closed vs. open to the carrier?

My WAG is that the car was shipped on an open carrier, rear-end first,
and that the deck lid was not latched. LM latches (and some EM too)
have been known to stick in the unlatched position when old and
disused. Anyway, the wind caught it, flipping it open with the force
you describe.

As others have noted, without some way to demonstrate that the car was
undamaged prior to shipping...
